So even if you are not involved in a collision, but have concerns about your coverage, we will review your insurance free of charge to make sure you and your family is fully protected. We’ll explain “Limited Tort”, “Stacking”, “Underinsured and Uninsured Motorist” coverages, Medical and Wage Loss coverage.
When reviewing insurance protection, one of the land mines we look for is whether you selected the “full tort” or “limited tort” option. With the “full tort” option, the person retains their rights and can make a claim against the person who caused their injuries and harm. With the “limited tort” option, in exchange for a reduction in premiums, the person gives up their right to sue the driver who was responsible for a collision and their injuries, unless the person can demonstrate that they suffered a “serious impairment of a bodily function”. Thus anyone suffering strains, sprains or even broken bones that eventually heal are typically not able to file suit even though their recovery may take several months, they may miss substantial time from work or daily activities and may be in substantial pain for weeks or months.
Even if your insurance company states that you selected the “limited tort” option, you still may be able to recover. Insurance companies have an obligation under Pennsylvania Law to produce specific documents signed by you to prove the limited tort selection. There are also certain exceptions to the “limited tort” option
